1. Who these terms are with
Fenix is operated by Walid Dawoud, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany. Full provider details are in the Legal Notice.
By creating a Fenix account or using the app, you agree to these terms. If you do not agree with them, please do not use Fenix.
2. What Fenix is — and what it is not
Fenix is a personal growth app. It offers written lessons, short daily exercises, insights, affirmations and guided meditation, so you can practise small changes in everyday life.
Fenix is not medical care, therapy, psychological treatment or crisis support. Nothing in the app is a diagnosis, and nothing in it replaces a doctor, therapist or other qualified professional. Some lessons touch on difficult inner material — practise at your own pace, stop if something feels harmful, and if you are struggling, talk to someone qualified.
Results are not promised. What you get out of a practice depends on you, your circumstances, and factors neither of us controls.
3. Your account
You need an account to use Fenix. You are responsible for keeping access to it secure, and for what happens under it.
You must be at least 16 years old to create an account. If you are younger, a parent or guardian must agree to these terms on your behalf.
Provide accurate information when you sign up, particularly your email address — it is how we reach you about your account.
4. Subscriptions, trials and billing
Parts of Fenix are free forever, with no account limits and no advertising. Other parts require a Fenix Premium subscription. What is free and what is paid is stated in the app before you are asked to pay anything.
Purchases are made through Apple, not through us. When you subscribe, your contract for that payment is with Apple under the terms of your Apple Account. We never see or store your payment details.
- Plans. Fenix Premium is offered as a monthly or an annual subscription. The exact price is always shown in your own currency in the app before you confirm.
- Free trial. New subscribers may be offered a free trial. Its length and the price charged when it ends are both shown before you confirm. One trial is available per subscription group, so switching plans does not start a second trial.
- Automatic renewal. Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before that period ends. Apple charges your Apple Account within 24 hours before renewal.
- Cancelling. You can cancel at any time in your Apple Account subscription settings — on iPhone, under Settings, your name, then Subscriptions. Cancelling stops the next renewal. You keep access until the period you already paid for has finished.
- Price changes. If a price rises, Apple notifies you in advance and, where required, asks you to agree before the new price applies.
5. Right of withdrawal and refunds
As a consumer in the EU, you have a statutory right to withdraw from a distance contract within 14 days without giving a reason. Because Fenix Premium is digital content supplied immediately, this right ends once supply has begun with your express consent and your acknowledgement that the right is lost — which is what you confirm when you complete the purchase.
This does not limit your statutory rights where a service is faulty.
Refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We cannot issue, approve or reverse a refund on Apple's behalf. If something has gone wrong, write to us anyway at hello@getfenix.app — we would rather hear about it.
6. How you may use Fenix
Fenix is for your own personal use. You may not:
- copy, resell, republish or redistribute the lessons, exercises, insights or meditations;
- share your account so that other people use one subscription;
- try to break, probe or bypass the app's security, or access other people's data;
- use automated means to extract content from the app or the service behind it.
What you write inside Fenix — notes, affirmations, feedback — belongs to you. We do not sell it, publish it, or use it to train anything. How your data is handled is set out in the Privacy Policy.
7. Our content
The lessons, exercises, insights, meditations, text, design and artwork in Fenix belong to us or are used with permission. Your subscription gives you a personal, non-transferable right to use them inside the app. It does not transfer ownership.
Where a lesson draws on a named idea or thinker, that origin is stated in the text itself.
8. Availability and changes
We work to keep Fenix available and to keep adding to it, but we cannot promise uninterrupted service. Maintenance, an app store outage, or a problem at a service we depend on can all interrupt it.
Content changes over time. Lessons get rewritten, exercises get replaced, and new material is added. A subscription is to Fenix as it is at the time, not to one fixed set of content.
If we ever make a significant change to what a subscription includes, we will tell you inside the app before it takes effect.
9. Ending the agreement
You can stop using Fenix and delete your account at any time from inside the app. Deleting your account removes your data as described in the Privacy Policy. It does not by itself cancel a subscription — cancel that in your Apple Account settings.
We may suspend or close an account that seriously or repeatedly breaks these terms. Where it is reasonable to do so, we will tell you why first.
10. Liability
We are liable without limit for injury to life, body or health caused by our negligence, and where liability is mandatory under the German Product Liability Act, and for damage caused intentionally or by gross negligence.
For slight negligence, we are liable only where we breach an obligation that is essential to the purpose of this agreement, and then only for foreseeable damage typical of this kind of contract.
Any liability beyond that is excluded. Your statutory consumer rights are not affected by these terms.
11. Governing law
German law applies. If you are a consumer resident in the EU, you also keep the protections of the mandatory law of your own country — nothing here takes those away.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
12. Changes to these terms
We may update these terms — for example when a feature changes or the law does. The date at the top of this page always shows the current version.
If a change materially affects your rights, we will tell you in the app or by email before it takes effect, and you will have the chance to cancel if you do not accept it.
